Small- wood e ala against the Board of City Council, asking for an injunction against the collection of the Graded School tax, came up before Judge Shepherd. The case was argued on behalf of the plain tiffs by H. C. Whitehurst, and for the city and Board of Trustee by Hon. C. C, Clark and Clement Manly. The in unction was denied. Plaintiffs appealed to the Supreme Court. - Kinston Items. The receipts of cotton were very fair last week. The best sold for 9 to 94. One of Horner's Oxford boys. W. A. Phillips, is at home, on the winter vacation. Sam. J. Hudson, of Jones county, and MissLucretia Edwards, of this place, were married here on the 5th instant by Rev. C. S. Cashwell. On the 6th instant, at the residence of Owen bmith, in Lenoir county, Mr, Allen D. Smith and Miss Elizabeth Smith were linked together by Jesse Jackson, J. P, ; K Our vigilant sheriff has all the delin quent tax payers hung upon a tree at the court house. They had better call and pay themselves down and keep bet ter company hereafter. ... J. Green Haynes, one of the executors named in the will of the late Sam New man, says that there are "too many fingers in that pie for a man of his stanaing ana business capacity to en gage in it. He believes there are $5,000 ;10,UUU and a large part of the per Simmon crop on Jake Parrott s land due the old soldier of the Mexican war and if his co-executors would resign or die, he would collect the money and persimmons and supply the neighbors with beer, if it took all the money to do He is willing, however, that his co- executor, Jim Wilkins, may wind up the business of the Ink Factory estab lished during the late war by the de ceased and his widow. The Standard Dramatic Company played four successive nights last week at Lof tin's Opera House, to good crowds. The manager McElreth, is a comic actor of no mean parts. He knows what will please the boys and girls and draws them like a "big bug." The scenery and appointments of tlio hou8e, though not finished, are very pleasing and help greatly the effect of the plays. Several troups have engage ments here for January and followipg months, promising a gay time for the Kinstonians this winter. The public spirit of . the proprietor, Mr. Loftin-, in thus catering to the amusements of our people is very , commendable. When the house is fully completed, he will open it to the public, for one occasion, free, when its seating capacity will doubtlessly be fully tested. The fire company, the entire male population Of La Grange, was on hand . in less than five minutes with buckets and the fire was soon put out, The cotton caught from a match passing through the gin and at once went to the lint room, and nothing but cool judg ment and hard work saved the gin from being burned up. Mr. John Betts, revenue officer, accompanied By mi. a. v. wiiKinson, matte a visit to an alleged illicit distilery somewhere in the Flat River region last Saturday, and while they were paying their respects to it with an axe, some one secreted in a thicket near by, fired upon the officers, two of the shots taking enect in the forehead oi Mr. Betts. The dam age was slight, but taking the gen tlemen's word for it, the scare was complete, and Uncle Sam's men returned home to tell the tale. Wilmington Review: The traffic, both passenger and freight, on all the railroads and steamboats to and from this city is unusually large this season. Especially is this true of the several railroad lines, Steam boatmen report about four feet of water in the Cape Fear, which makes fair boating water, although it compels the pilots to be careful and lollow the channel, This section is sadly in need of rain. Fortunately, however, there are remarkably heavy dews of nights, which in a measure prevents the clouds ol dust which would otherwise be a great annoyance, Chatham Record: There is a man iving in this county who may be said to be judicially dead. During the war he was reported dead, and bis brother qn aimed, as the ad ministrator ol his estate and pro ceeded to settle it up, but after the war closed the "dead'7 man made his appearance and insisted that he was not dead, even if the court had' declared him so. A few days ago deputy marshal Ira Jfhfllips summoned a one-arm Con federate soldier, of this county, to go to Washington City as a witness against a pension claim agent, who is being prosecuted for attempted frauds. This scamp was in the habit of writing to ignorant dis abled Confederate soldiers, telling them that he would get them a pen sion, and requiring a small fee in advance to pay costs. Hanging would be too good ior such a swin dler. Charlotte Observer: Mrs. James Lanier, a lady of Steel Creek town ship, this county, met with a shock ing death at the home of her mother, Mrs. Esther Richardson, last Wednesday night. The unfor tunate lady was subject to epilep tic fits, and while in the room alone, was seized with one. At the time the fit came upon her, she was standing by the fireplace, and fell with her head in the fire. Betore her terrible situation was discov ered, she was burned so badly that death ensued in a few minutes. Mrs. Lanier had a narrow escape from a similar death not a great while ago. The scene of the calam ity is about three miles from Pine- ville. The deceased lady leaves a a husband and family of children. who - have the svniDathies ' of the ' community in their sad bereavement. " . - . About thirty-five emigrants have exodusted from this section this week for homes in the West. The tide of emigration still flows, but it is perceptibly weakening. Newa-Observer. M , ; k . Matter of iaw. ' A case of some little importance was decided by Judge Phillips on Tuesday. Thd Sheriff of New Hanover, in, collect ing the taxes for the State and county for 1383, found it necessary to garnishee a party doing business in the city for the tax due by his employees. - The em ployer consulted a lawyer who advisqd him that he could not be held responsible for any but the State part of said tax 1.12i.
